SIA Underrated, registration number 40203516176, address: Gaismas 4-11. Kuldiga, Latvia, LV-3301, hereinafter referred to as the online store, provides the content available on the website and offers goods/services in accordance with the terms set out below.

1. General Terms

When a consumer purchases goods/services through the website, such mutual agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia, including, but not limited to, the Consumer Rights Protection Law of the Republic of Latvia, the Cabinet of Ministers Regulations "Distance Contract," etc.

2. Making a Purchase

The prices and specifications of products sold in the online store are indicated next to the products. To place an order, add the desired products to the shopping cart, fill in all necessary fields, and choose the preferred delivery method. The total cost of the order with delivery will be displayed on the screen. Make the payment to complete the purchase.

3. Payment Terms

The currency for transactions on the site is the euro. Payment methods provided by the makecommerce.lv payment platform, Maksekeskus AS, include Latvian online bank payments (Swedbank, SEB, Citadele, and Luminor), Estonian online bank payments (Swedbank, SEB, Luminor), Lithuanian online bank payments (Swedbank, SEB, and Luminor), Finnish online bank payments, Visa/Mastercard card payments.

NB! When using the online bank payment method, confirm the order and click the "Return to Merchant" button.

Personal data required for payment is transferred to the licensed payment institution Maksekeskus AS. The contract becomes effective upon successful payment to the online store's bank account. If, for any reason, fulfilling the order is not possible, the buyer will be informed, and the paid amount will be refunded as soon as possible but no later than 14 days after receiving the notification.

4. Delivery Terms

Goods are delivered to the following countries: Latvia, Lithuania, Estonia. The purchased goods are delivered using: write here, for example, parcel delivery partner, courier, pick-up from the store, etc. All fees and taxes to be paid to receive the shipment are the responsibility of the buyer. Delivery costs are shown before confirming the order. The purchased goods are delivered to the buyer's specified address within - working days. In exceptional cases, we reserve the right to send the goods within 45 calendar days, notifying the customer.

5. Right of Withdrawal

The buyer has the right to withdraw from the purchase within 14 calendar days from the receipt of the goods. (Depending on the product, the buyer may not have mandatory withdrawal rights; in such cases, the reason must be clearly stated and explained). The right of withdrawal does not apply if the buyer is a legal person.

To exercise the 14-day right of withdrawal, the goods must be used only for their intended purpose. The consumer is responsible for maintaining the quality and safety of the goods during the withdrawal period. If the goods are improperly used or damaged, if the original packaging is lost, or if the packaging is significantly damaged, the online store has the right to reduce the refundable amount according to the decrease in the value of the goods.

To exercise the right of withdrawal, the buyer must submit the withdrawal form, which can be found here: (insert link to withdrawal form), by sending it to the email address underrated@underrated.lv within 14 days of receiving the goods. It is good practice to provide the buyer with free return of goods, increasing trust in the online store, which helps improve sales volumes.

The next paragraph is for online stores that cannot offer free product returns. The buyer covers the cost of returning the goods, except in cases where the reason for the return is that the product does not match the order (e.g., incorrect or damaged product).

The buyer's obligation is to return the goods to the seller without delay but no later than 14 days after sending the withdrawal form to the online store. Upon receiving the returned goods, the online store immediately, but no later than 14 days, refunds all payments received from the buyer based on the Distance Contract.

The seller has the right to withhold payment until the buyer provides proof of returning the goods or proof of return. If the buyer has chosen a shipping method other than the cheapest one offered by the online store, the online store is not obliged to compensate for the additional shipping costs.

The online store is not responsible for delays in fulfilling obligations or non-performance arising from circumstances and obstacles beyond the reasonable control of the online store.

The online store reserves the right to refuse to sell goods and request their return from the buyer if the price indicated in the online store is significantly lower than its market price due to errors.

6. Consumer Rights for Non-Conforming Goods

The online store is responsible for the non-conformity of goods sold to the buyer with the contract terms or defects that arise within 6 months from the date of delivery of the goods to the customer or were present at the time of delivery if such assumption is not contrary to the characteristics or defects of the item. The buyer must inform the seller immediately, within 2 months of discovering the non-conformity, by submitting a complaint. The buyer can submit a complaint by contacting the online store, writing to underrated@underrated.lv.

The online store is not responsible for defects that occur after the goods have been delivered to the buyer. If the purchased goods have defects for which the seller is responsible, the buyer has the right to request the elimination of defects or the exchange of goods for new ones free of charge.

If the goods cannot be repaired or replaced, the seller refunds all payments made by the buyer under the Distance Contract. The seller provides a written response to the consumer's complaint within 15 days.

7. Processing of Buyer's Personal Data

The online store processes only the personal data that the buyer has entered when ordering goods, such as name, surname, email, etc. The online store transfers personal data to the transport service provider(s) to ensure the delivery of goods.

If you have clearly agreed to receive our marketing notifications, including updates, we may occasionally contact you by sending information about our services and the latest offers. For this purpose, we may process your email address provided when subscribing to marketing communication. The buyer has the option to opt-out of marketing notifications by notifying us, writing to underrated@underrated.lv.

8. Dispute Resolution Procedure

In matters not covered by these terms and conditions, the buyer and the seller undertake to comply with the laws of the Republic of Latvia.

The parties resolve all disputes arising between the seller and the buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the parties will resolve the dispute in the courts of the Republic of Latvia, following the laws of the Republic of Latvia. Disputes between the buyer (consumer) and the seller can be submitted for resolution to the Consumer Rights Protection Center or the courts of the Republic of Latvia.

The buyer also has the right to appeal to the dispute resolution bodies of the European Union.
